 “This legislation springs from one of our most essential principles,” he said. “A democracy works best when the people have all the information that the security of the nation permits. No one should be able to pull curtains of secrecy around decisions which can be revealed without injury to the public interest.”

  If our 36th president was still with us he might have a terse verse or two when he found out that according to the D.O.D The Freedom of Information act is now…. I must sadly report, out of order. But really if they were telling the truth they would just come out and say it’s broken.

 

    The Freedom of Information Act (FOIA) is a law that gives us the right to access information from the federal fax machinegovernment. It is often described as the law that keeps citizens in the know about their government. Freedom of Information laws are vitally important to the fabric of any free society. They are an important resource for public accountability and the equal treatment of all people under the rule of law.  They are important to the advancement of commerce and science industries which depend on an open flow of information.  They are one of the most important factors contributing to the legitimacy of all democratically elected governments.  For without access to government records, citizens cannot determine whether their leaders deserve reelection or whether they should be thrown out of office because of fraud or mismanagement. Though the Freedom of Information act was not passed until 1966, the government’s openness with information was principle even in its foundation nearly 200 years earlier.  As is evident when James Madison, a key participant in the formation of our American republic and its constitution stated in 1822:

“A popular Government without popular information, or the means of acquiring it, is but a Prologue to a Farce or a Tragedy; or perhaps both. . . .  A people who mean to be their own Governor, must arm themselves with the power which knowledge gives.”

 

    It might sound laughable, and I regret to report that last week mukrock.com as well as several other verified sources can now confirm that the Freedom of information act is now completely “out of order.”  A single fax machine at the D.O.D (Department of Defense) that was responsible for handling all FOIA requests is to this day, broken. In response, a D.O.D memo states that a new fax machine could take as long as 3 months to acquire. Though the D.O.D has promised to speed up this process due to increased public scrutiny, I am not holding my breath. Why you may ask do I take such an outwardly pessimistic tone in regards to the matter? Because the pure and simple fact that the freedom of information act is not only out of order, it’s just downright broken. You see for a long time there has existed an ever expanding pile of caveats to this law. Small additions, such as answers to requests taking upwards of 16 years, have been added to this law to weaken it. But recently those weighty additions have finally sunk the law, along with the righteous intentions of its creators. FOIA requests can now have an expandable price tag. We have seen single requests cost more than 1,000,000 dollars. The federal government has begun a process of intimidation against some of the laws biggest proponents such as internet hero Aaron Swartz, who was indicted on charges totaling more than 50 years, all for the very terrible crime of uploading information from MIT’s library to an open source website. The indictment and its implications were contributing factors when Aaron Swartz chose to take his own life.
